Terms of Service

Please read these Terms of Service ("Terms", "Terms of Service", "Agreement") carefully before using the FillASurvey website, mobile application, or any related services (collectively, the "Service") operated by FillASurvey ("we", "us", "our", "Company").

Company Information: FillASurvey is a subsidiary of GoRemote Africa. The Service is operated by FillASurvey as part of the GoRemote Africa group of companies.

IMPORTANT - BINDING AGREEMENT: By creating an account, clicking "I Agree", accessing, browsing, or using the Service in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must immediately discontinue use of the Service and may not create an account.

Eligibility: You must be at least 18 years old and have the legal capacity to enter into binding contracts to use this Service. By using the Service, you represent and warrant that you meet these requirements.

Accounts

Account Creation

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

Account Security

Your Responsibility:

  • You are solely responsible for safeguarding the password, authentication method, or any other credentials used to access the Service
  • You are responsible for ALL activities and actions that occur under your account, whether authorized by you or not
  • You are responsible for activities whether your password is with our Service or a third-party service (such as Telegram)
  • You must use a strong, unique password and keep it confidential
  • You must not share your account credentials with any third party

Security Obligations:

  • You agree not to disclose your password or authentication credentials to any third party
  • You must notify us IMMEDIATELY (within 24 hours) upon becoming aware of any breach of security or unauthorized use of your account
  • You must log out of your account when using shared or public devices
  • You must report suspicious activity immediately

No Liability for Unauthorized Access:

  • We are not liable for any loss or damage arising from unauthorized access to your account
  • We are not liable for any actions taken through your account, whether authorized or not
  • You are solely responsible for maintaining the confidentiality of your account credentials
  • You agree to indemnify us for any losses resulting from unauthorized access to your account

Account Types

Survey Creators (Researchers):

  • Can create surveys and workspaces
  • Can fund surveys and pay respondents
  • Must maintain sufficient wallet balance for active surveys
  • Responsible for survey content and compliance with all applicable laws and these Terms
  • Must ensure surveys are designed for legitimate research, data collection, or feedback purposes
  • Prohibited from creating surveys for propaganda, misinformation, conflict-inciting, or manipulative purposes
  • Must design surveys with objective, unbiased questions that do not frame issues to push specific agendas

Survey Respondents (Users):

  • Can participate in surveys
  • Can earn rewards for completing surveys
  • Must provide accurate responses
  • Must comply with survey participation rules

Survey Participation

Respondent Obligations

When participating in surveys, you agree to:

  • Provide honest and accurate responses
  • Complete surveys in good faith
  • Not use automated tools or bots
  • Not create multiple accounts to participate in the same survey multiple times
  • Respect survey creators' intellectual property

Quality Standards

We monitor survey responses for quality. Responses that are:

  • Completed too quickly (indicating lack of engagement)
  • Repetitive or nonsensical
  • Submitted by automated tools
  • Duplicate submissions from the same user

May be flagged for review. Quality scores are advisory: they do not automatically withhold or claw back a completed response's payment. A researcher may dispute a completed response within 72 hours, and platform staff decide the dispute.

Survey Rewards

  • The reward shown when you start is reserved together with your response slot. Complete and submit the required visible questions before the reservation expires to receive it.
  • A reservation lasts at least 15 minutes, or three times the survey's estimated duration when that is longer. A valid reservation can still be completed after a survey is paused.
  • Successful submission credits the reserved reward to your personal earnings wallet. A later change to the survey's reward does not change an existing reservation's reward.
  • Minimum cashout and processing fees are shown in the wallet using the current fee schedule. Successful ID verification and a payout bank account matching the verified name are required.
  • Payment processing is handled through Fincra. A failed payout returns both the held payout amount and the processing fee to the wallet.

Referral Program Rewards

FillASurvey may offer a referral program that allows users to invite other eligible users through a unique referral code or referral link.

Respondent referrals: You earn ₦100 for each 10 qualifying paid surveys completed by an invited respondent, up to 30 milestones (the first 300 qualifying completions), for a maximum of ₦3,000 per respondent.

Researcher referrals: You earn ₦1,000 once when an invited researcher makes their first qualifying top-up of at least ₦10,000 for a workspace they own.

Eligibility and timing:

  • Referral codes are attached at account creation and cannot be added or changed afterwards.
  • Respondent completions count only after the invitee verifies their ID and the response reward has been paid. Responses with an upheld quality dispute do not count for future milestones; existing pay is not automatically clawed back.
  • Self-referrals using the same Telegram account, identity or payout bank account are ineligible.
  • The programme may be disabled before launch. There is no back pay for activity before the programme launches.
  • If the monthly programme budget is exhausted, earned rewards remain pending for payment when budget is available.
  • Rewards are credited to the referrer's personal earnings wallet, separate from workspace spending balances.

Payment Terms

Payment Processing

We use Fincra, a third-party payment processor, to handle wallet top-ups and cashouts. By using our payment features, you agree to Fincra's Terms of Service and Privacy Policy.

Wallet Top-Ups (Researchers)

  • Fincra processes top-ups for workspace spending wallets. A verified email and workspace owner or admin permissions are required.
  • Before payment, the quote shows the gross amount, platform fee, VAT on the platform fee and the net amount credited. The effective fee schedule determines the current rates and minimum top-up.
  • Credit is applied only after the payment status, amount and currency have been verified with the processor.

Survey Budgets and Refunds

  • Publishing funds a capped survey by moving its budget into survey escrow. Each response start reserves its slot and reward.
  • Closing, expiring, suspending or reducing the capacity of a survey returns unused funds to its workspace wallet. Funds already committed to valid reservations or unpaid completions remain reserved for those commitments.
  • A workspace has no self-service cashout in this version. Contact support about a manual refund; a refund or adjustment is recorded through the ledger.

Cashouts (Respondents)

  • The wallet shows the current minimum payout, processing fee and total wallet debit before confirmation.
  • Cashouts are processed to Nigerian bank accounts through Fincra. The bank account name must match the verified identity.
  • A payout remains pending while its outcome is being checked. If it fails, both the payout amount and the processing fee return to the earnings wallet.

Payment Disputes

If you have a dispute regarding a payment:

  1. Contact us at [email protected] within 30 days
  2. Provide transaction details and reason for dispute
  3. We will investigate and respond within 14 business days

Identity Verification

Verification Requirements

We may require identity verification for:

  • High-value cashouts
  • Account security purposes
  • Fraud prevention
  • Regulatory compliance

Verification Methods:

  • ID verification via Prembly (BVN, NIN, voter card, passport, driver's license, and document capture)
  • Phone number verification
  • Email verification

Verification Data

Verification data is:

  • Processed securely and encrypted
  • Used only for verification purposes
  • Retained as required by law
  • Not shared with third parties except as necessary for verification services

BVN and Identity Document Handling:

  • Identity document details may be transmitted to Prembly to perform verification.
  • Verification is processed synchronously and results are returned immediately.
  • Failed outcomes may include a failure reason, which we may show in product surfaces to help you retry correctly.
  • We do not persist plaintext BVN in our database; we retain masked verification references and verification outcome metadata required for security, support, audit, and compliance.

Consent: By providing verification data, you explicitly consent to its processing for verification purposes.

Failed Verification

If verification fails:

  • You may be unable to access certain features
  • Cashouts may be delayed or restricted
  • We will notify you of the reason and next steps

If verification is not successful, you may be blocked from adding or using payout bank accounts until verification requirements are met.

Intellectual Property

Our Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of FillASurvey and its licensors. The Service is protected by copyright, trademark, and other laws of Nigeria and foreign countries.

Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

Survey Content

Survey Creators:

  • You retain ownership of survey questions and content you create
  • You grant FillASurvey a license to host, display, and process your surveys
  • You are responsible for ensuring your survey content does not infringe third-party rights

Survey Respondents:

  • Your survey responses are owned by you
  • By submitting responses, you grant the survey creator a license to use your responses for the survey's stated purpose
  • Survey creators may use aggregated, anonymized response data

User-Generated Content

You retain ownership of content you create but grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and distribute your content as necessary to provide the Service.

By using our Service, you acknowledge and agree that:

  • These third-party services have their own terms and privacy policies
  • We are not responsible for the practices of third-party services
  • You use third-party services at your own risk
  • You should review third-party terms and privacy policies

Our Service may contain links to third-party websites or services that are not owned or controlled by FillASurvey.

FillASurvey has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that FillASurvey shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods, or services available on or through any such websites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.

Account Deletion and Data Export

Account settings in the dashboard and profile settings in the mini app provide data export and account deletion. You may also contact [email protected].

Before deletion, withdraw any earnings balance, wait for pending payouts to finish, and transfer or delete workspaces you own. These conditions prevent funds or shared workspaces from being stranded.

Deletion removes account access and anonymises the account's personal profile and credentials. Survey responses, ledger history and records that must be retained remain associated with an anonymised account. There is no 30-day account recovery window.

The self-service data export provides account information, responses, transaction history and consent records. Security secrets and other people's private data are excluded, and bank account numbers are masked.

User Warranties and Representations

By using the Service, you represent and warrant that:

  1. Legal Capacity: You are at least 18 years old and have the legal capacity to enter into binding contracts
  2. Accurate Information: All information you provide is accurate, current, and complete
  3. Authorization: You are authorized to use any payment method or bank account you provide
  4. Compliance: Your use of the Service will comply with all applicable laws and regulations
  5. No Violation: Your use will not violate any third-party rights (including intellectual property, privacy, or publicity rights)
  6. No Fraud: You will not engage in any fraudulent, deceptive, or illegal activities
  7. Sole Responsibility: You are solely responsible for all content you create, post, or submit
  8. Ownership: You own or have the right to use all content you submit
  9. No Conflicts: Your use of the Service does not conflict with any other agreements or obligations

False Representations: Any false representation or warranty may result in immediate account termination and legal action.

Prohibited Uses

You expressly agree NOT to use the Service for any of the following prohibited purposes:

  1. Fraud and Abuse:

    • Creating multiple accounts to circumvent limits
    • Using automated tools or bots
    • Providing false or misleading information
    • Attempting to manipulate survey results

  2. Illegal Activities:

    • Any unlawful purpose
    • Violating any laws or regulations
    • Infringing intellectual property rights
    • Harassing, threatening, or harming others

  3. Service Interference:

    • Attempting to hack, disrupt, or damage the Service
    • Introducing viruses or malicious code
    • Overloading servers or infrastructure
    • Reverse engineering or attempting to extract source code

  4. Content Violations:

    • Creating surveys with illegal, harmful, offensive, defamatory, or discriminatory content
    • Spam or unsolicited communications
    • Phishing or fraudulent surveys
    • Surveys that violate third-party rights
    • Surveys that contain malware, viruses, or malicious code

  5. Propaganda and Conflict-Inciting Content:

    • Creating surveys designed to promote propaganda, misinformation, or disinformation
    • Surveys that manipulate or frame questions to push specific political, religious, ethnic, or social agendas
    • Surveys intended to incite, promote, or exacerbate conflicts, violence, hatred, or division
    • Surveys that target or disparage specific groups based on race, ethnicity, religion, nationality, gender, or other protected characteristics
    • Surveys designed to spread false narratives or manipulate public opinion through misleading framing
    • Surveys that could reasonably be expected to contribute to social unrest, violence, or harm to individuals or communities
    • Surveys that use loaded language, leading questions, or manipulative techniques to influence responses toward predetermined conclusions
    • Surveys that exploit sensitive topics (conflicts, crises, tragedies) for purposes other than legitimate research or data collection

Content Review and Moderation: We reserve the right, but are not obligated, to review, screen, edit, reject, remove, or suspend any survey or content that we determine, in our sole discretion:

  • Violates these Terms or any applicable law
  • Contains propaganda, conflict-inciting content, or manipulative framing
  • May harm individuals, groups, or communities
  • Does not serve legitimate research or data collection purposes

We are not obligated to provide reasons for survey rejection, removal, or suspension. Our decisions regarding content are final and binding.

Consequences of Prohibited Use: Violation of prohibited uses may result in:

  • Immediate account termination without notice
  • Forfeiture of all rewards and wallet balance
  • Legal action and reporting to law enforcement
  • Liability for damages and legal costs
  • Permanent ban from the Service

Termination

By You

You may terminate your account at any time by requesting account deletion (see Account Deletion section above).

By Us

We may terminate or suspend your account immediately, without prior notice, for:

  • Breach of these Terms
  • Fraudulent activity
  • Violation of applicable laws
  • Any other reason we deem necessary

Upon termination:

  • Your right to use the Service will cease immediately
  • We may delete your account and data (subject to legal retention requirements)
  • You will not be entitled to refunds for unused services

Service Availability and Modifications

No Guarantee of Availability:

  • The Service is provided on an "as-is" and "as-available" basis
  • We do not guarantee uninterrupted, secure, or error-free operation
  • We reserve the right to modify, suspend, or discontinue any part of the Service at any time
  • We are not liable for any loss or damage resulting from Service unavailability

Service Modifications:

  • We may modify, update, or change the Service at any time without notice
  • We may add, remove, or modify features without prior notification
  • We are not obligated to maintain or support any specific features
  • Your continued use after modifications constitutes acceptance

Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • No Warranty of Merchantability: We do not warrant that the Service will meet your requirements
  • No Warranty of Fitness: We do not warrant that the Service is fit for any particular purpose
  • No Warranty of Accuracy: We do not warrant the accuracy, completeness, or usefulness of any information on the Service
  • No Warranty of Non-Infringement: We do not warrant that the Service will not infringe third-party rights
  • No Warranty of Security: We do not warrant that the Service will be secure or free from viruses or harmful components

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FILLASURVEY, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR:

  1. Indirect Damages: Any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

    • Loss of profits, revenue, data, or business opportunities
    • Loss of goodwill or reputation
    • Cost of substitute services
    • Emotional distress or mental anguish

  2. Third-Party Services: Any damages arising from third-party service failures, including:

    • Fincra payment processing failures
    • Telegram authentication failures
    • Plunk email delivery failures
    • Any other third-party service we use

  3. Data Loss: Any loss or corruption of data, including:

    • Survey responses
    • Account information
    • Payment data
    • Any other data stored on or transmitted through the Service

  4. Service Interruptions: Any damages resulting from:

    • Service unavailability or downtime
    • Technical failures or errors
    • Maintenance or updates
    • Force majeure events

TOTAL LIABILITY CAP: Our total liability to you for all claims arising from or related to the Service shall not exceed the greater of:

  • The amount you paid us in the 12 months preceding the claim, OR
  • One Hundred Naira (₦100)

NO LIABILITY FOR USER CONTENT: We are not liable for any content created, posted, or submitted by users, including survey content, responses, or communications.

ACKNOWLEDGMENT: You acknowledge that the limitations and exclusions of liability set forth in this section are reasonable and that we would not provide the Service without such limitations.

Indemnification

YOU AGREE TO DEFEND, INDEMNIFY, AND HOLD HARMLESS FILLASURVEY, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS FROM AND AGAINST ANY AND ALL CLAIMS, DAMAGES, OBLIGATIONS, LOSSES, LIABILITIES, COSTS, DEBT, AND EXPENSES (INCLUDING BUT NOT LIMITED TO ATTORNEY'S FEES AND COURT COSTS) ARISING FROM:

  1. Your Use of Service:

    • Your access to or use of the Service
    • Your violation of any provision of these Terms
    • Your violation of any applicable law or regulation
    • Your infringement of any third-party rights (including intellectual property, privacy, or publicity rights)

  2. Your Content:

    • Content you create, post, submit, or transmit through the Service
    • Survey questions, responses, or other user-generated content
    • Any false, misleading, or fraudulent information you provide

  3. Your Conduct:

    • Your interactions with other users
    • Your violation of survey participation rules
    • Your fraudulent or abusive activities
    • Your unauthorized access to or use of the Service

  4. Third-Party Claims:

    • Claims by other users related to your use of the Service
    • Claims by survey creators or respondents related to your actions
    • Any other claims arising from your use of the Service

This indemnification obligation will survive termination of your account and these Terms.

Force Majeure

We shall not be liable for any failure or delay in performance under these Terms which is due to circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters, acts of God, or weather conditions
  • War, terrorism, riots, or civil unrest
  • Government actions, laws, or regulations
  • Internet or telecommunications failures
  • Cyberattacks, data breaches, or security incidents
  • Third-party service provider failures
  • Labor strikes or work stoppages
  • Pandemics or public health emergencies
  • Any other event beyond our reasonable control

During such events, we may suspend or limit access to the Service without liability.

Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law provisions.

Jurisdiction

Any disputes arising from or related to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Nigeria. You consent to the personal jurisdiction of such courts and waive any objection to venue.

Dispute Process

  1. Informal Resolution: You must first contact us at [email protected] to attempt good-faith resolution within 30 days
  2. Mediation: If informal resolution fails, disputes may be referred to mediation in accordance with Nigerian mediation rules
  3. Arbitration: If mediation fails, disputes shall be resolved through binding arbitration in Nigeria in accordance with Nigerian arbitration laws
  4. Legal Action: Either party may pursue legal action in Nigerian courts for injunctive relief or matters not subject to arbitration

Class Action Waiver

YOU AND FILLASURVEY AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to participate in class actions, collective actions, or representative proceedings.

Changes to Terms

Right to Modify: We reserve the right to modify, update, or change these Terms at any time, in our sole discretion, with or without notice to you.

Notification of Changes: For material changes, we will attempt to notify you by:

  • Posting the updated Terms on our website with a new "Last Updated" date
  • Sending you an email notification to the email address associated with your account
  • Displaying a notice within the Service
  • Requiring acceptance of new Terms before continued use (for significant changes)

Your Responsibility: It is your responsibility to review these Terms periodically for changes. Your continued use of the Service after any changes constitutes your acceptance of the modified Terms.

Objection to Changes: If you do not agree to the modified Terms, you must immediately stop using the Service and may request account deletion.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.

Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and FillASurvey regarding the Service and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written, between you and FillASurvey.

Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of FillASurvey.

Assignment

You may not assign or transfer these Terms or your account, by operation of law or otherwise, without our prior written consent. We may assign or transfer these Terms or our rights and obligations hereunder, in whole or in part, without your consent.

Acceptance and Acknowledgment

BY CREATING AN ACCOUNT, CLICKING "I AGREE", "SIGN UP", "REGISTER", OR OTHERWISE ACCESSING OR USING FILLASURVEY, YOU:

  1. Acknowledge that you have read these Terms of Service in their entirety
  2. Understand all provisions, including limitations of liability and indemnification obligations
  3. Agree to be legally bound by these Terms and our Privacy Policy
  4. Represent that you are at least 18 years old and have legal capacity to enter into this agreement
  5. Consent to electronic delivery of notices and communications
  6. Waive any rights or remedies not expressly granted herein

IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST IMMEDIATELY DISCONTINUE USE OF THE SERVICE AND MAY NOT CREATE AN ACCOUNT.

Your use of the Service constitutes your acceptance of these Terms and creates a legally binding agreement between you and FillASurvey.
